Terms of service
Please read these Terms carefully. They govern your use of hudsonsfurniture.com and any purchase you make through it.
1. Agreement to these Terms
hudsonsfurniture.com is operated by Hudson's Furniture Inc., which we'll call "Hudson's," "we," "us," or "our." When you visit the site, create an account, or place an order, you agree to these Terms and to our Privacy Policy.
If you don't agree, please don't use the site.
Our showrooms are operated by an affiliated Hudson's company. These Terms cover your use of the website and the orders you place through it. A purchase made in person at a showroom is governed by the sales documents you sign there.
2. Other policies that are part of these Terms
Several of our policies live on their own pages because they're long enough to deserve one. They're part of this agreement just as if they were printed here:
-
Privacy Policy, covering what we collect and what choices you have
-
Shipping and Delivery Policy, covering delivery areas, scheduling, fees, and inspection at delivery
-
Return and Refund Policy, covering what can be returned, in what condition, and by when
-
Replacement Plan Terms, if you purchase a replacement plan
-
Promotional terms, published with each offer
If something in one of those policies conflicts with these Terms, that policy controls for the subject it covers.
3. Who can use the site
You must be at least 18 years old and able to enter a binding contract. The site is intended for customers in the United States, and we deliver only to the 48 contiguous states. We don't ship to Alaska, Hawaii, U.S. territories, or international addresses.
If you're using the site for a business, a designer's client, or a trade account, you're confirming you have authority to act for them.
4. Your account
You can shop as a guest or create an account. Accounts use a one-time code sent to your email rather than a password, so keeping access to your email address is what keeps your account secure.
You agree to give us accurate information and to keep it current.
You're responsible for keeping your account secure and for activity that happens under it. That means keeping the email account we send codes to secure, not sharing sign-in codes with anyone, and signing out when you're using a shared or public computer. If you let someone else use your account, you're responsible for what they do with it.
Tell us promptly at [email protected] or (877) 340-5799 if you believe someone has gained access to your account or used it without your permission.
We may suspend or close an account that's being used to break these Terms, to commit fraud, or in a way that harms other customers.
5. Placing an order, and when a contract forms
When you submit an order, you're making an offer to buy. The confirmation email we send is an acknowledgment that we received your order. It isn't acceptance. A contract forms only when we accept your order, which happens when we ship it, schedule its delivery, or tell you in writing that we've accepted it.
Until then, we may decline or cancel an order, in whole or in part, for reasons including:
-
The item is out of stock, discontinued, or no longer available from the manufacturer
-
The price or product description was wrong, as described in Section 6
-
We can't verify your billing or delivery information
-
We suspect fraud, resale, or a violation of these Terms
-
The delivery address is outside our service area
If we cancel an order you've already paid for, we'll refund you in full using your original payment method. That refund is our only obligation to you for the cancelled order.
We may also limit quantities, refuse orders that look like they're for resale, and require additional verification before we ship a high-value item.
6. Prices, pricing errors, and taxes
Prices are shown in U.S. dollars and don't include tax, delivery, or assembly unless we say so.
Pricing and description errors. We work hard to keep prices and product details accurate, but with more than 20,000 products, errors happen. If an item's price or description is wrong, we may correct it or cancel the order, even after you've received a confirmation. If we cancel for this reason and you've already paid, we'll refund you in full. We'll always contact you rather than silently charging a different amount.
Price changes. Prices can change at any time. The price that applies to your order is the one displayed when we accept it.
Promotions and codes. Promotional offers, discount codes, and financing offers have their own terms, including expiration dates, minimum purchase amounts, and product exclusions. Unless an offer says otherwise, only one promotional code applies per order and codes can't be combined. We may end or change a promotion at any time. Codes have no cash value and can't be applied to a completed order.
Price match. Our price match offer has its own published terms, including which retailers and what evidence qualify.
Sales tax. We collect sales tax where the law requires it, based on your delivery address.
7. Product images, materials, and availability
Furniture is made from natural materials, and photographs are taken under lighting that no living room reproduces exactly. So:
-
Colors, finishes, and textures vary between what you see on a screen and what arrives.
-
Wood grain, leather markings, stone veining, and fabric dye lots vary from piece to piece, and between a floor model and the one delivered to you. That variation is a property of the material, not a defect.
-
Dimensions are approximate and may vary slightly.
-
Fabric and finish options shown online may differ from what's currently offered by the manufacturer.
Availability shown online may differ from what's on a showroom floor. Floor models and clearance items are sold as-is, in the condition described at the time of sale.
We recommend measuring your space, your doorways, and your stairwells before ordering. Delivery teams can't remove doors or hoist furniture through windows.
8. Special orders and custom pieces
Special order and custom items are built or finished to your selections and can't be resold to another customer. Once we place a special order with the manufacturer, it generally can't be cancelled, changed, or returned.
We'll tell you before you buy if an item is a special order.
9. Delivery, returns, and inspection
Delivery, shipping charges, scheduling, and what to do about damage are covered in our Shipping and Delivery Policy. Returns, exchanges, and refunds are covered in our Return and Refund Policy. Both are part of these Terms.
One point worth repeating here because it's easy to miss: inspect your furniture at the time of delivery and note any damage on the delivery paperwork before the crew leaves. Damage reported later is harder to resolve with the carrier and the manufacturer, and our ability to help you depends on it.
10. Financing
We offer financing and lease-to-own through Synchrony and Affirm. Those are separate companies with their own applications, agreements, rates, and privacy policies. Hudson's isn't the lender and isn't a party to your financing agreement. Approval, terms, and credit decisions are theirs alone. Questions about your account go to them.
11. Warranties
Most of what we sell carries a manufacturer's warranty. We pass those warranties through to you and we'll help you file a claim, but the manufacturer is the one who honors it, on its own terms and for its own period.
Mattresses, upholstery, and outdoor furniture typically carry different warranty terms and different exclusions. Normal wear, damage from misuse or improper cleaning, and issues caused by an unsupported foundation are commonly excluded. Read the warranty that comes with your product.
If you buy a replacement plan, that plan is a separate agreement with its own coverage, exclusions, and claims process.
EXCEPT FOR ANY MANUFACTURER WARRANTY AND ANY WRITTEN WARRANTY WE PROVIDE, AND EXCEPT WHERE THE LAW DOESN'T ALLOW IT, THE SITE AND EVERYTHING SOLD THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." HUDSON'S DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Some states don't allow the exclusion of implied warranties, so this may not apply to you.
12. Electronic communications
When you use the site or contact us, you agree that we can communicate with you electronically, and that agreements, notices, and disclosures we send electronically satisfy any legal requirement that they be in writing.
You can text our showrooms and designers at the numbers we publish. Standard message and data rates apply. Marketing email is opt-in and every message includes an unsubscribe link. Transactional messages about your order continue regardless, because you need them.
13. Reviews, photos, and anything else you post
You may be able to submit reviews, ratings, photos, and other content. You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, adapt, and distribute it in connection with our business, including in marketing, for as long as we're in business.
When you post, you're confirming that:
-
You own it or have the right to share it
-
It's accurate and reflects your genuine experience
-
It doesn't infringe anyone's rights or violate any law
-
It isn't unlawful, threatening, harassing, hateful, obscene, or deceptive
-
Anyone recognizable in a photo has agreed to appear in it
Don't post other people's personal information, and don't post someone else's copyrighted work.
We don't review everything that gets posted and we're not responsible for it. We may remove or refuse to publish content at our discretion, but we're not obligated to monitor. We don't edit review content to change its meaning, and we don't suppress reviews because they're negative.
14. How you may and may not use the site
You may use the site to shop, research products, and manage your orders. You may not:
-
Use bots, scrapers, or automated tools to collect prices, product data, images, or content
-
Buy products for resale, or place orders you don't intend to complete
-
Interfere with the site's operation, probe it for vulnerabilities, or try to gain unauthorized access
-
Use another person's account, payment method, or identity
-
Reverse engineer, copy, or create derivative works from the site
-
Use the site to send spam, malware, or unsolicited commercial messages
-
Frame the site, or misrepresent your relationship with Hudson's
-
Use our content to train a machine learning model without our written permission
We may investigate and take legal action against anyone who violates this section, and we may block access without notice.
15. Our intellectual property
The site, including its text, product descriptions, photography, video, graphics, layout, and code, belongs to Hudson's or our licensors and is protected by copyright, trademark, and other laws. "Hudson's Furniture," "Hudson's Furniture + Mattress," "Turning Houses Into Homes," and our logos are our trademarks.
Product names and brand marks belong to their owners. Selling a brand doesn't make us its owner and doesn't give you a license to use its marks.
You may view, download, and print pages for your own personal, non-commercial use in connection with shopping with us. Everything else requires our written permission.
16. Third-party links and services
The site links to other websites and embeds services we don't control, including brand partners, financing providers, review platforms, and social media. We're not responsible for their content, their products, or their privacy practices. Your dealings with them are between you and them.
17. Copyright complaints
If you believe something on our site infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent:
Copyright Agent Hudson's Furniture Inc. 3290 W 1st St, Sanford, FL 32771 [email protected]
Your notice needs to include your signature, identification of the work, identification of the material you say infringes it and where it is on our site, your contact information, a statement that you believe in good faith the use isn't authorized, and a statement under penalty of perjury that your notice is accurate and that you're authorized to act for the copyright owner.
18. Accessibility
We want the site to be usable by everyone, and we work to improve it on an ongoing basis. If you have trouble using any part of it, contact us at [email protected] or (877) 340-5799 and we'll help you complete your purchase and work on the underlying problem.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HUDSON'S AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT, EVEN IF WE'VE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT THAT THE CLAIM IS ABOUT, OR $100 IF THE CLAIM DOESN'T RELATE TO A PURCHASE.
Nothing in these Terms limits liability that can't be limited by law, including liability for fraud, for personal injury caused by our negligence, or under any manufacturer warranty.
Some states don't allow these limitations, so parts of this section may not apply to you.
20. Indemnification
You agree to indemnify and hold Hudson's harmless from claims, damages, and reasonable legal fees arising out of your violation of these Terms, your misuse of the site, or content you post. We'll notify you of any such claim and you may participate in the defense at your expense. We won't settle a claim in a way that imposes an obligation on you without your consent.
21. Resolving disputes
Talk to us first. Most problems get solved by a phone call. Before starting a formal proceeding, contact us at [email protected] or (877) 340-5799 and describe the problem and what you'd like us to do. Give us 30 days to work it out. Most disputes end here.
Binding arbitration and class action waiver. If we can't resolve a dispute informally, you and Hudson's agree that any dispute arising out of these Terms, the site, or a product purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in Seminole County, Florida, or by videoconference or on the documents alone, at your choice. You and Hudson's each waive the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding. The arbitrator may award the same individual relief a court could. Either of us may bring an individual claim in small claims court instead. You may reject this arbitration agreement by writing to us at the address in Section 24 within 30 days of your first purchase, and rejecting it won't affect anything else in these Terms.
Governing law and venue. These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. For any dispute not subject to arbitration, you and Hudson's agree to the exclusive jurisdiction of the state and federal courts located in Seminole County, Florida.
Time limit. Any claim relating to the site or a purchase must be brought within one year after it arises, to the extent the law allows a contractual limitation period.
22. Changes to these Terms
We may update these Terms. The effective date at the top shows the current version. If we make a material change, we'll post notice on the site before it takes effect. Continuing to use the site after that means you accept the updated Terms. The version in effect when you placed an order governs that order.
23. General
Severability. If a provision is found unenforceable, the rest stays in force.
No waiver. If we don't enforce a provision, that isn't a waiver of our right to enforce it later.
Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms, together with the policies listed in Section 2 and any sales documents you sign, are the complete agreement between us about the site and your online purchases.
Force majeure. We're not liable for delays or failures caused by events outside our reasonable control, including hurricanes and severe weather, which in Florida is a real consideration for delivery schedules, and also including manufacturer delays, carrier disruptions, labor shortages, and utility or network failures.
Headings. Headings are for convenience and don't affect interpretation.
